XRadar Terms of Service

These Terms of Service ("Terms") govern your use of the XRadar mobile application and related services (collectively, the "Service") operated by XRadar ("us", "we", or "our").

1. Acceptance of Terms

By accessing and using XRadar, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

XRadar is a mobile application that provides real-time bus tracking information for college campuses. The services included rely partially on data from campus providers such as PassioGo and ETASpot:

• Real-time GPS tracking of campus buses
• Estimated arrival times at bus stops
• Route information and schedules
• Push notifications for bus arrivals and delays
• Campus-specific transportation information

3. User Accounts and Registration

Currently, XRadar does not require user registration or account creation. The app can be used anonymously. If we introduce user accounts in the future, additional terms will apply.

4. Acceptable Use

You agree to use XRadar only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the application
• Use automated systems to access the service without permission
• Interfere with or disrupt the service or servers connected to the service
• Attempt to gain unauthorized access to any portion of the service

5. Data Accuracy and Reliability

While we strive to provide accurate and up-to-date bus tracking information, we cannot guarantee the accuracy, completeness, or reliability of the data. Bus schedules and locations may change due to traffic, weather, mechanical issues, or other factors beyond our control.

Users should not rely solely on XRadar for critical transportation decisions and should have backup transportation plans when necessary.

6. Service Availability

We aim to provide continuous service availability, but we do not guarantee that the service will be uninterrupted or error-free. The service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Third-party service disruptions
• Force majeure events

7. Intellectual Property Rights

The XRadar application, including its design, functionality, and content, is owned by XRadar and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the application for personal, non-commercial purposes.

8. Third-Party Services

XRadar may integrate with third-party services (such as PassioGo for bus tracking data) to provide our service. We are not responsible for the availability, accuracy, or content of these third-party services. Your use of such services may be subject to their own terms and conditions.

9. Limitation of Liability

To the fullest extent permitted by law, XRadar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the service.

In no event shall our total liability exceed the amount you paid for the service in the twelve months preceding the claim (which is currently $0 as the service is free).

10. Indemnification

You agree to indemnify and hold harmless XRadar and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the service or violation of these Terms.

11. Termination

We may terminate or suspend your access to the service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or our website. Your continued use of the service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
